General Terms and Conditions
Scope
1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all services offered by PeSchCo UG, Süntelstr.14 31848 Bad Münder (hereinafter referred to as “Provider”) via the online platform https://www.baskardo-nonsmokersystem.com/ – especially the paid online prevention courses (hereinafter referred to as “Online Program or Online Course”).
1.2 By using the online platform, or at the latest when ordering access to the Online Program in a legally binding manner, the user acknowledges the validity of these GTC.
1.3 In these GTC, “user” refers to any natural person who registers on this online platform to book a prevention course.
1.4 The secure areas mentioned in these GTC are areas of the online platform that are only accessible to registered users and cannot be viewed by third parties.
1.5 The online prevention courses mentioned in these GTC are online courses that provide knowledge and practical content for a healthier lifestyle.
Subject Matter of the Contract
2.1 Online prevention courses are offered on the online platform. Users can inform themselves about the online course/s before purchasing. When booking the course, access is also generated, which is sent to the email address provided during the sales process.
2.2 Online courses booked by participants are available in a protected area in text form, as PDF, as audio, and in video form. These can be accessed after payment using the provided access data. By purchasing a course, the participant agrees to be contacted by the provider by email or phone.
Purchase Process/Registration
3.1 To gain access to the protected area or to the course content, purchasing the respective course or registration for free offers is necessary. The user must fill out the sales form for the respective course and provide all the data requested in the sales form completely and truthfully.
3.2 After purchasing the course, a username and password are set for the user. These can be changed at any time. Additionally, an email address must be provided, which is regularly checked for new emails. The access data will be sent to this email address. By clicking on the link in the email with the access data, the user confirms and activates his customer account. If the online course is paid for by bank transfer, the respective course will only be activated upon receipt of payment.
3.3 Passwords for the online platform must always be kept confidential. Users are responsible for all activities and bookings made using their password. The provider may require users to change their passwords. Furthermore, it may be required that access be deactivated indefinitely if a security breach or misuse on the online platform is suspected.
3.4 Prices for the online courses can be viewed on the respective subpages of the online platform.
3.5 In order to ensure payment with a credit card or bank card, credit card or account information is collected for the purchase process.
3.6 Payments are due upon conclusion of the contract. All prices include the respective applicable statutory value-added tax.
3.7 It is assumed that the user has a terminal device and an internet connection. The user bears the costs arising from this.
Forum & Contact Options
4.1 After logging in, participants will find a forum on the website. The primary exchange takes place among participants here. In addition, additional information and offers are made available to participants.
4.2 Participants decide autonomously whether and to what extent they use the forum and what information they enter into the forum.
4.3 The provider is not responsible for the truth, content, or quality of the participant’s information.
4.4 All information is public and is checked and moderated by the administrators at regular intervals.
4.5 The administrators have the right to remove entries in the forum.
Time Frame of Offers and Termination Conditions
5.1 All online courses conducted on the online platform are completed within the specified time frame and automatically end at the end of this period.
5.2 After the online course has ended, it can still be viewed for another 4 weeks. After that, access to the course content is blocked.
5.3 If there is a gross breach of the contractual framework (e.g., use of access by multiple participants), the provider can terminate the contract without notice.
Revocation
REVOCATION INSTRUCTION
Right of Revocation
The user has the right to cancel the booking of the online course within 14 days of purchase.
For this, the user must send a clear declaration to the email specified in the imprint (https://stop-smoking-now.de/baskardo-machtdicheinfachzumnichtraucher/impressum) or inform by post of the desire to cancel.
The cancellation request will be confirmed by email.
The payment made will be returned to the payment medium used for the purchase within 14 days.
If you request that the service begin during the revocation period, you must pay an appropriate amount. This corresponds to the proportion of the service that was provided up to the point at which you informed of the exercise of your right of revocation.
END OF REVOCATION INSTRUCTION
The user confirms that he/she is not currently or has not been in psychotherapeutic treatment within the last six months.
The user confirms that he/she does not suffer from a mental illness.
Liability
7.1 Participation in all online courses offered on the online platform is at the participant’s own risk.
7.2 No guarantee is given for the success of a prevention course.
Data Protection Information

Copyright Protection
9.1 The content offered on the online platform is protected by applicable copyright laws. Content may only be used for private and non-commercial purposes. Commercial reproduction or commercial distribution of copyrighted content to third parties is prohibited and will be legally pursued by the provider.
Amendment of the GTC
10.1 The provider is entitled to change the GTC at any time. If a change to the GTC should occur, this will be pointed out to users with a notice period of at least one week.
Applicable Law and Jurisdiction
11.1 The law of the Federal Republic of Germany applies, excluding the UN sales law. Place of jurisdiction is the location of the provider’s registered office.
Final Provisions
12.1 If individual provisions of these GTC should be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
